If you have consented to the processing of your data, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of personal data pursuant to Art. 9(1) GDPR are processed. If you have consented to the storage of cookies or to access to information on your device (e.g. via device fingerprinting), the data processing is additionally based on Section 25(1) TTDSG. Consent may be withdrawn at any time.

If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary to comply with a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the specific legal bases applicable in each individual case is provided in the following sections of this privacy policy.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You may withdraw any consent you have already given at any time. The lawfulness of data processing carried out prior to the withdrawal shall remain unaffected by the withdrawal.

Right to Object to Data Collection in Certain Cases and to Direct Marketing (Art. 21 GDPR)

IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

WHERE YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to Data Portability

You have the right to have data which we process automatically on the basis of your consent or in fulfilment of a contract provided to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be carried out where technically feasible.

Information, Erasure and Rectification

Within the framework of applicable statutory provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients and the purpose of data processing and, where applicable, the right to have this data rectified or erased. You can contact us at any time regarding this or any other questions relating to personal data.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to exercise this right. The right to restriction of processing exists in the following cases:

If you dispute the accuracy of your personal data stored by us, we will generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.

If the processing of your personal data was or is unlawful, you may request the restriction of data processing instead of the erasure of the data.

If we no longer need your personal data, but you require it for the exercise, defence or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.

If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. Until it has been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, such data may, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a Member State.

Enquiries by Email, Telephone or Fax

If you contact us by email, telephone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request. We will not pass this data on without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), where this has been requested; consent may be withdrawn at any time.

The data you send to us as part of contact enquiries will remain with us until you request its deletion, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Data Processing for Contract Fulfilment

We collect personal data when you voluntarily provide it to us as part of your order or when contacting us (e.g. via contact form or email). Mandatory fields are marked as such because, in these cases, we require the data for the fulfilment of the contract or to process your enquiry, and you will not be able to complete your order or submit your enquiry without providing it. The data collected can be seen in the respective input forms.

We use the data you provide to fulfil the contract and process your enquiries (including enquiries regarding and the handling of any existing warranty claims and claims arising from defective performance, as well as any statutory updating obligations) in accordance with Art. 6(1)(b) GDPR. Further information on the processing of your data, in particular on the disclosure of data to our service providers for the purposes of order processing, payment processing and shipping, can be found in the following sections of this privacy policy.

Once the contract has been fully performed, your data will be restricted from further processing and deleted after the expiry of any tax and commercial retention periods in accordance with Art. 6(1)(c) GDPR, unless you have expressly consented to further use of your data in accordance with Art. 6(1)(a) GDPR or we reserve the right to use the data beyond this period where permitted by law and have informed you of this in this privacy policy.

Contact

As part of customer communication, we collect personal data to process your enquiries in accordance with Art. 6(1)(b) GDPR if you voluntarily provide this data when contacting us (e.g. via contact form or email). Mandatory fields are marked as such because, in these cases, we require the data to process your enquiry. The data collected can be seen in the respective input forms.

Once your enquiry has been fully processed, your data will be deleted unless you have expressly consented to further use of your data in accordance with Art. 6(1)(a) GDPR or we reserve the right to use the data beyond this period where permitted by law and have informed you of this in this privacy policy.

8. Data Processing for Shipping

For the fulfilment of the contract in accordance with Art. 6(1)(b) GDPR, we pass your data to the shipping service provider commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods.

Disclosure of Data to Shipping Service Providers for Delivery Notifications

If you have expressly consented to this during or after placing your order, we will pass your telephone number to the selected shipping service provider on the basis of Art. 6(1)(a) GDPR, so that the shipping service provider can contact you before delivery for the purpose of notifying you of the delivery or coordinating the delivery.

You may withdraw your consent at any time by sending a message to the contact details provided in this privacy policy or directly to the shipping service provider using the contact details listed below. Following withdrawal, we will delete the data you provided for this purpose, unless you have expressly consented to further use of your data or we reserve the right to use the data beyond this period where permitted by law and have informed you of this in this privacy policy.

9. Data Processing for Payment Processing

When processing payments in our online shop, we work with the following partners: technical service providers, credit institutions and payment service providers.

Data Processing for Transaction Processing

Depending on the payment method selected, we pass the data required to process the payment transaction to our technical service providers, who act as our processors, or to the commissioned credit institutions or the selected payment service provider, insofar as this is necessary to process the payment. This serves to fulfil the contract in accordance with Art. 6(1)(b) GDPR.

In some cases, payment service providers collect the data required to process the payment themselves, e.g. on their own website or through technical integration into the ordering process. In this respect, the privacy policy of the respective payment service provider applies.

If you have any questions about our payment processing partners or the basis of our cooperation with them, please contact us using the contact details provided in this privacy policy.

Data Processing for Fraud Prevention and Optimisation of Our Payment Processes

Where applicable, we provide our service providers with additional data which they use, together with the data required to process the payment, as our processors for the purposes of fraud prevention and optimising our payment processes (e.g. invoicing, handling disputed payments and supporting accounting).

This serves, pursuant to Art. 6(1)(f) GDPR, to safeguard our legitimate interests, which prevail as part of a balancing of interests, in protecting ourselves against fraud and in efficient payment management.

Involvement of Debt Collection Agencies

We pass your data to a commissioned debt collection agency insofar as our payment claim has not been settled despite a prior reminder. In this case, the claim will be collected directly by the debt collection agency.

This serves the fulfilment of the contract pursuant to Art. 6(1)(b) GDPR as well as safeguarding our legitimate interests, which prevail as part of a balancing of interests, in effectively asserting and enforcing our payment claim pursuant to Art. 6(1)(f) GDPR.
